Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern access to and use of CFOmarketIQ (the "Service"), operated by CFOmarketIQ ("we," "us," or "our"). By creating an account, starting a trial, or using the Service, you agree to be bound by these Terms on behalf of yourself and, if applicable, the company you represent.

2. Description of Service

CFOmarketIQ provides an AI-generated business intelligence agent that summarizes and contextualizes micro and macro events relevant to a subscriber's business, delivered as periodic or on-demand briefings. The Service is a decision-support tool and does not constitute financial, investment, legal, accounting, or tax advice, and should not be relied upon as the sole basis for any business or financial decision.

3. No Financial Advice

Nothing on this website and nothing contained in any briefing, email, or other material delivered through the Service is financial, investment, legal, accounting, or tax advice. This applies to every page of the CFOmarketIQ website, including sample briefings and blog posts, and to every briefing we deliver by email, Slack, Teams, or any other channel. All content is provided for general informational purposes only.

CFOmarketIQ is not a registered investment adviser, broker-dealer, financial planner, accountant, or law firm, and nothing produced by the Service creates a fiduciary, advisory, or professional relationship of any kind. Briefings are generated by an AI system from publicly available sources and may contain errors, omissions, or out-of-date information. Any decision you make remains your own, and you should consult a qualified professional before acting on anything you read on this site or receive from us.

4. Subscriptions, Trials, and Billing

Subscriptions are billed monthly or annually in advance, as selected at signup. New subscriptions include a 7-day free trial; if not canceled before the trial ends, the subscription automatically converts to a paid plan and billing begins. Subscriptions renew automatically at the end of each billing period unless canceled prior to renewal. One-time briefings are billed at the time of purchase and are not subscriptions. Additional seats are billed per seat at the then-current rate. All fees are non-refundable except where required by law or expressly stated otherwise.

5. Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period; you will retain access to the Service through that date, and no partial refunds are issued for the remainder of a billing period.

6. Refunds, Upgrades, and Downgrades

Fees are non-refundable except where required by law or expressly stated in this section. The following applies to subscription changes and one-time purchases:

Free trial briefing: The free trial briefing is provided at no cost and no payment method is required, so no refund applies.

One-time briefings: One-time briefing purchases are billed at checkout. Once briefing generation has begun, the purchase is final and non-refundable, as the briefing is a completed deliverable produced specifically for you.

Subscription trials: New subscriptions include a 7-day free trial. Canceling before the trial ends avoids any charge. Once the trial converts to a paid subscription, standard subscription refund terms apply.

Upgrades: Upgrading to a higher-tier plan takes effect immediately. Any price difference for the remainder of the current billing period is prorated and charged at the time of upgrade.

Downgrades: Downgrading to a lower-tier plan takes effect at the start of your next billing period. You retain access to your current plan's features through the end of the period you have already paid for, and no partial refund is issued for the difference.

Billing errors: If you believe you were charged in error (for example, a duplicate charge), contact support within 30 days of the charge for a review and, where appropriate, a correction or refund.

7. Acceptable Use

You agree not to: (a) share account credentials or briefings outside your organization in violation of these Terms; (b) reverse engineer, scrape, or attempt to extract the underlying methodology or models of the Service; (c) use the Service for any unlawful purpose; or (d) resell or redistribute the Service without our written consent.

8. Intellectual Property

Briefings generated for your account are yours to use for your internal business purposes. We retain all rights, title, and interest in and to the Service itself, including our software, models, methodology, and underlying technology.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or timeliness of any briefing or its underlying sources. You are solely responsible for decisions made based on information provided by the Service.

10. Limitation of Liability

To the maximum extent permitted by law, CFOmarketIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim arising from these Terms will not exceed the amount you paid us in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or for non-payment. Upon termination, your right to use the Service ends immediately, though certain provisions of these Terms will survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
